1. Introduction
Welcome to Motionlabs Media. These Terms and Conditions (“Terms”) govern your access to and use of our services, website, and any content provided by Motionlabs Media (Pty) Ltd (“we”, “our”, or “us”). By engaging our services, visiting our website, or communicating with us, you agree to be bound by these Terms.
2. Services Offered
Motionlabs Media provides creative production services including, but not limited to:
- Music video production
- Videography and photography
- Corporate and branded video production
- Live streaming
- Advertisements and media content
- Audio-visual design and editing services
All services are subject to availability and a signed agreement or written confirmation.
3. Bookings and Payments
- All projects must be confirmed via written approval or signed quotation/invoice.
- A non-refundable deposit of 50% is required to secure your booking.
- The balance is payable upon completion, unless otherwise agreed.
- Delays in payment may result in withheld delivery of content or additional charges.
4. Client Responsibilities
The client is responsible for:
- Providing accurate project briefs, timelines, and required materials (e.g., scripts, branding).
- Securing required permissions or licenses for third-party music, talent, or location use.
- Ensuring the availability of subjects, locations, or products as agreed upon.
5. Revisions and Changes
- Motionlabs Media allows for one (1) round of standard revisions per project.
- Additional changes may incur extra charges depending on scope and time.
- Requests for major changes after project completion will be treated as a new task and quoted separately.
6. Cancellations and Postponements
- If a project is cancelled after confirmation, the initial deposit will be retained.
- Postponements must be communicated at least 72 hours in advance. Rescheduling is subject to availability.
- Same-day cancellations or no-shows may be billed in full
7. Ownership and Copyright
- Motionlabs Media retains full copyright of all footage, edits, and original content created unless otherwise agreed in writing.
- Final delivered content may be used in our portfolio, website, or social media for promotional purposes unless the client requests otherwise in writing.
- Clients receive a usage license for agreed platforms and purposes only.
8. Turnaround Time
- Standard turnaround time is 5–15 working days, depending on project size and complexity.
- Urgent deadlines must be discussed in advance and may carry an additional fee.
9. Limitation of Liability
Motionlabs Media is not liable for:
- Losses due to delays caused by force majeure, technical failure, or client-related issues.
- Indirect, incidental, or consequential damages arising from use of our services or media.
10. Confidentiality
We respect the confidentiality of all projects and client information. All sensitive materials shared with us will be handled with discretion and will not be disclosed without permission, unless required by law.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising will be subject to the jurisdiction of South African courts.
